Powers of Attorney (property + personal care)

Two separate documents: one for financial/property decisions if you become incapacitated, one for health and personal care decisions. Typically named to different people. Essential alongside a will.

Eligibility

  • Canadian adult of sound mind
  • Separate documents for each type of POA
  • Can be specific (durable/enduring) or general

Limits and rules

  • POA for property: handles finances during incapacity, ends at death
  • POA for personal care: handles health decisions, ends at death
  • Provincial names vary: POA in Ontario, Representation Agreement in BC, Mandate in Quebec
